Study On Improving The Control System Aimed To Prevent The Reformed People From Relapsing Into Crimes

Recommitting crimes of the reformed people has become a global-level issue,which is an unstable factor of the social stability and public security regardless of its means of committing crimes,quantity of criminal cases,or its destructive nature.The Settling-down and assisting work refers to the educational and directory activities for those reformed people who have been released from prison for less than five years,with the unified leadership of the Party Committees and governments of all levels.The reformed people,due to the short transition period from the prison to the society,pose lots of problems,such as unstable emotional status,lacking in self constrict in their mindsets which often occur to their work and lives.If these problems cannot be addressed in time with necessary management and assistance,part of them will possibly risk to relapse into crimes.Therefore,the government must create and improve the control system to prevent them from recommitting crimes,in order to eliminate the potential hazard to the society.And we need to take efforts to intervene with the management of the reformed people in order to secure long-term social stability and to accelerate the socialist legal construction.The author,from the perspective of government,carries out research on the Jiangbei Ningbobased reformed people who were released in the years between 2012 and 2016 by Ningbo Jiangbei government,judicial department,and the subordinate judicial offices.The research includes a questionnaire survey of more than 200 reformed people,an analysis of self-reflection of more than 500 people on the their own crimes,conversations with over 200 reformed people.The result is presented as follow.First,the proportion of flagrant crimes among those committed by recidivists is relatively high.The newly committed crimes are more serious than former ones,as well as the means of committing the new crimes.2 、 Secondly,we are witnessing a trend of juvenile delinquency of recommitting crimes which means the young aged are becoming the major part to recommit crimes.Thirdly,education,family background,crime types are forming the foundation of recidivism.The reason behind the mismanagement of recommitting crimes lies in the facts that the reformed people are facing the difficulty of employment and the social discrimination,which as a result distorts their outlook on life.Also,the control measures and relative laws and rules cannot be applied to address this issue.So,we need to implement a sound policy to create a control system to contain the recidivism,and make clear its basic goal,working principle,and plans to carry out.Also,it is appropriate to transform the government function and working conception to improve the systematic construction,to encourage the social force to take part in the work of managerial innovation to socialize and marketize the settling-down and assisting project of the reformed people who should be led into the path of legal construction of the control system.
