Inprove The Research On The System Of China Marine Law Enforcement

The 21 st century is the century of ocean.With ocean oil and gas resources widely used and blue economy developing fast,various countries are paying more attention to the ocean land,and ocean sovereignty disputes are increasing.In the meanwhile,economic globalization has made the world trade globalized,and more than 80% goods is transported by sea.In recent years,the maritime terrorism is spreading,pirates are inundating,and crimes on sea are increasing,which have caused great harm to the national security.Therefore,coastal countries have to strengthen the construction of maritime law enforcement power,safeguard national marine rights and jurisdiction maritime safety.In this paper,the reform and development courses of China’s maritime law enforcement system are combed and concluded.Through the field research,and by organizing a visit to coast guard corps,coastal patrol,fishery and related units,I have examined achievements and the insufficiency of the current maritime law enforcement system reform of our country,and summed up the main problems of China’s current maritime law enforcement.Based on the theoretical research results of scholars at home and abroad,I have analyzed reasons leading to the inefficiency of China’s maritime law enforcement system.Then,combine with different types of the world’s major national maritime law enforcement system and the development trend of maritime law enforcement system,use the method of comparative study: one is cross country comparison,that is,to analyze the types and characteristics of maritime law enforcement system of other countries having advanced maritime management,and draw lessons from foreign advanced practice and successful experience.Two is the history of the longitudinal comparison,that is,to summarize the world’s leading national maritime law enforcement power construction and development situation,sum up the experiences of other countries’ reform,and hope to give enlightenment to China’s maritime law enforcement system reform direction.Adhere to the principle of theory with practice,analyze maritime law enforcement system models of the United States,Britain and neighboring countries such as Japan,South Korea,Indonesia and etc.,summarize the differences and development trend,and provide advice for China’s maritime law enforcement system reform combining with China’s actual conditions.Finally,put forward some suggestions: to build a complete set of Marine legal system,promote the reform of unified main body for the maritime law enforcement,set up a top-down vertical management system,perfect the personnel management system with the active duty personnel as the main body,establish the coordination mechanism with Marine department,accelerate the innovation of the “army-police-people” mechanism construction,and construct a coast guard team which have a variety of properties such as military,police and administrative.
