On The Construction Of Competition Policy Of The China-Japan And South Korea Free Trade Agreement

With the deepening of the global economic integration,the competition policy of free trade agreement has attracted more and more attention from the international community.Competition policy plays an important role in regulating the private limited competition,maintaining the fair and effective competition in the market.And it guarantees greatly the realization of regional trade liberalization and economic integration.China-Japan and South Korea Free Trade Agreement is still in the negotiation stage.In this paper,we will study the content and characteristics of the three free trade agreements in the North American Free Trade Agreement,the Europe and South Korea Free Trade Agreement and the Trans-Pacific Partnership Agreement.The author tries to give some suggestions to constructing the competition policy of China-Japan and South Korea Free Trade Agreement.This paper consists of four parts,and the main contents are as follows:The first part introduces the meaning and historical background of the free trade agreement competition policy,and summarizes the characteristics of the free trade agreement competition policy.Then it analyzes the characteristics of the value target of the free trade agreement competition policy,and finally expounds the present situation and the development trend of the free trade agreement competition policy.The second part introduces the necessity and feasibility of bring China-Japan and South Korea Trade Agreement into the competition policy.This part proves the necessity of putting China-Japan-South Korea Free Trade Agreement into the competition policy from the following four aspects: the included competition policy is conducive to the realization of regional trade liberalization,improves economic efficiency,promotes the interests of consumers and improves the environment of regional competition.And we will focus on analyzing the feasibility of bringing China-Japan-South Korea Free Trade Agreement into the competition policy.The third part introduces the content and characteristics of the three free trade agreements:the North American Free Trade Agreement,the Europe-Korea Free Trade Agreement and the Trans-Pacific Partnership Agreement.And we are expecting to learn something useful from China-Japan-South Korea Free Trade Agreement by analyzing the policy of three free trade agreements.The fourth part is the suggestions on how to construct the competition policy of China-Japan-South Korea Free Trade Agreement.On the basis of the analysis of the free trade agreements: the North American Free Trade Agreement,Europe and South Korea and the Trans-Pacific Partnership Agreement,we will come up with some specific suggestions on constructing the competition policy of China-Japan-South Korea Free Trade Agreement,such as how to choose the target of the competition policy of China-Japan-South Korea Free Trade Agreement,the applicable law enforcement principle,procedural and substantive provisions,and Dispute settlement mechanism.
