Research On The Legal System Of International Cargo Clearance

International cargo clearance is one of the most important issues in international trade in the context of trade facilitation.The Agreement on Trade Facilitation is a multilateral trade agreement under the WTO framework.After several twists and turns,it finally passed in December 2013.And in February 22,2017,the Treaty officially entered into force.On September 4,2015,China approval The Agreement on Trade Facilitation,which have a huge impact on China’s customs clearance system of goods.The Agreement on Trade Facilitation sets out new requirements for international cargo clearance in terms of transparency,import and export procedures,fees and charges,cargo clearance of goods and freedom of transit.Although China has achieved certain results in simplifying the document and strengthening supervision through the reform of cargo clearance and the project of Pilot Free Trade Zone.However,due to the non-standard international cargo clearance legal system,the unclear content of legal norms,the integration of law enforcement problems and the existence of international cooperation defects,we have the gap between the implementation of the A-type commitment.In view of the problems existing in the legal system of international cargo clearance,the international organizations and foreign outstanding legislative practice have provided the experience of the perfection of our legal system in unifying the classification of goods,ensuring the security of customs clearance and simplifying the customs clearance procedures.By analyzing the existing problems in the practice of international cargo clearance in China and drawing on the excellent experience in international laws and foreign laws,we can start from improve the legal system of cargo clearance,integrate the existing regulations of cargo clearance,further clarify the ambiguities in the current law.Optimize the cargo clearance procedures,enhance the level of risk management,the establishment of partnership between customs and enterprises,change the mode of law enforcement and other means to achieve customs clearance management model changes;the use of special regulatory policy advantages,signed the international cooperation framework for law enforcement agreement,with " the Belt and Road ”and China-ASEAN strategic partnership advantage to promote Connectivity,strengthen customs enforcement international cooperation.
