A Study Of The Government Improved Rescue Approaches To International Fishery Cases

Since 21 st century,the strategic position of the ocean has gained much more significance,but incidents in foreign fishery industry occurred frequently,such as the detention,penalty and sentences of fishermen,the conflicts with foreign fishing boats or foreign marine police,the injuries and deaths caused by the attacks on Chinese fishing boats.All these have a bad effect on Chinese people's lives,property,and the state's marine rights and safety.A proper solution to these incidents will have a positive effect on maintaining the safety of fishermen and the state property,safeguarding state interests and shaping a good international image.In fact,it is quite urgent for the government to establish and improve the emergency rescue mechanism.This paper begins with the explanation of fishery incidents concerning foreign countries and emergency management 4R theory.Then by gathering and studying Fujian fishery incidents concerning foreign interests in the past 20 years,this paper analyzes the current situation and shortcomings of the government rescue mechanism,including relief agencies,organizational systems and legal deficiencies,and analyzes the case of the problem,including rescue team construction lack of standards,emergency rescue plan isn't operational,legislative work isn't perfect.At last,the paper puts forward some strategies and measures to improve the government's emergency management of fishery incidents,which involves the building of rescue teams and organizations to solve foreign-related fishery incidents,the training and dills of fishermen to handle emergencies,the melioration of diplomatic interaction with neighboring countries,the improvement of laws and regulations in resolving fishery incidents,the use political and diplomatic negotiations,and the improvement laws to solve international fishery disputes.
