Study On Tourism Legal System Under Comprehensively Implementing The Rule Of Law

The 18th national congress of the communist party of China(CPC)proposed that the rule of law is a fundamental way of governing governance,and that the rule of law should be accelerated in order to speed up the construction of a socialist country under the rule of law.In October 2014,the fourth plenum of the communist party of China 18th project for the first time to discussing the issue of governing the country according to law,passed on comprehensively advancing the rule of law "the central committee of the communist party of China,the decision of the major issues",reiterated the important thought of the rule of law,rule of law as jack,in the process of advancing the rule of law,tourism is one of the important content of the rule of law construction,under this big background,the 12th session of the standing committee of the National People's Congress made the proposals.The tourism industry has the reputation of "smokeless industry" and "permanent sunrise industries",which is of great significance to expanding employment and raising taxes.Since the 21st century,China's tourism developed rapidly and continuously with international tourism,use legal means to regulate and guide,ensuring the healthy and stable development of tourism,is in today's China to promote economic development and current situation of the construction of the rule of law society.Perfect tourism legal system is the premise and guarantee for "cure" in accordance with the law,but now the tourism legislation in China is relatively backward,some complexity,strong comprehensive tourism problems still exist.This topic is mainly in the context of a comprehensive law on tourism for the construction of rule of law research,first of all,from the comprehensive governing the country according to law,tourism law and proposals related overview,and then expounds the comprehensive governing the country according to law and the relationship of the rule of law of tourism;Then from the need of building a socialist country under the rule of law,the need of protecting the legal rights and interests of tourists,the need of protection of tourist resources in our country,the needs of the development of tourism industry,especially international tourism from four aspects this paper expounds the necessity of implementing tourism in our country the rule of law construction.Then,the paper focuses on the legal thinking,the principle of rule of law,the legal thinking of the subject of tourism market,and the guiding principle of the principle that should be upheld.At last this paper is the focus of the article,from the problems existing in the tourism legislation,law enforcement,the problems of the problems existing in the judicial,travel participants legal consciousness existing problems from several aspects discusses the existing problems of the rule of law construction,tourism and analyses the cause of the problem and improve the legislative work,strengthen law enforcement,optimize the tourism judicial mechanism,law-abiding awareness education the public four aspects of the improvement of the legal environment of our country travel.The author hope that through to the problems of tourism in the construction of the rule of law,and analyze the causes of the problem,can put forward the constructive Suggestions on the construction of tourism in our country.
