A Study On The Protection Of Minority Traditional Culture Intellectual Property Rights

The traditional culture of ethnic minorities is the sum of spiritual wealth and material wealth retained by successive generations of ethnic minorities.The traditional culture of ethnic minorities in our country is rich in content and varied in form,not only contains the briliant history of various ethnic minorities,but also embodies the spirit of a national development,and it also enriches the traditional culture of the Chinese nation.Focusing on the process of modernization of the traditional culture of ethnic minorities,and using the legal means to protect them is our unvoidable mission.It is of great significance to deeply understand the traditional culture of ethnic minorities and clarify the legal protection principle of ethnic minorities.Traditional culture of ethnic minorities is an indispensable part of Chinese civilization,and provides spiritual nutrition for the unified development of our country.However,it is regrettable that the process of development and inheritance of traditional culture of ethnic minorities is facing development difficulties and poor living environment.Gannan Tibetan Autonomous Prefecture is located in the south of Gansu Province.It is located at the junction of Gansu,Qinghai and Sichuan provinces.The development of traditional culture of ethnic minorities in Gannan is of representative in minority areas.Based on the necessity of protecting the traditional culture of ethnic minorities,this paper takes Gannan Tibetan Autonomous Prefecture of Gansu Province as an example,to analyze the necessity and urgency of the protection of intellectual property rights of traditional culture of ethnic minorities on the basis of comprehensively introducing the concept,characteristics and value of minority traditional culture,and the status quo of intellectual property protection of traditional culture of ethnic minorities in Gannan.Based on the combination of UNESCO and other countries experience on the protection of intellectual property rights of traditional culture and intangible cultural heritage of ethnic minorities,this paper puts forward some suggestions on the protection of intellectual property rights of traditional culture of ethnic minorities in China.This paper also explores the protection of intellectual property rights of traditional culture of ethnic minorities from legislation,judicial application and interest allocation mechanism perspective in order to promote the inheritance and development of intellectual property protection of traditional culture of ethnic minorities in China.
