The Research To Legal Problems Of Regulation Of Genetically Modified Crops Planting

It has been cleared that transgenic technique is a major project of national science and technology in 13 th Five-Year National Science and technology innovation planning issued by Council State in 2016.It has also stated that government would improve the overall level of agricultural transgenic research to the front ranks of world,to offer stock of variety and technology for insuring national food security.In consideration of the close relationship between genetically modified crops and well-being of people’s life as well as lasting stability of our country,our government attach high importance to this technology.It is found that there are many legal researches on bio-safety management,environmental risk and food safety of transgene,while less on legal problems of supervision and management on GMOs’ plant by my searching and consulting literature.Therefore,I studied the regulation on GMOs’ plant and analyzed its problems and reasons and then make suggestion,by combining my own understanding,applying law knowledge and clearing relevant policies,regulations and literatures.The thesis can be divided into four parts to research the problem of planting regulation of transgene crops in the thought of raising issue,analyzing and solving problems.In the first part: To introduce current situation of the regulation of genetically modified crops in our country and raise problems.It mainly proposes the two problems of supervision,which are about legislation and department,through elaborating the current situation transgene crops planting.In the second part: To analyze problems of planting regulation of genetically modified crops.It analyzes three legal issues involved in the planting regulation of genetically modified crops: necessity and feasibility;problems of legal supervision and management;reasons about illegal plant of genetically modified crops.In the third part: To use the experience of other countries for reference.It works out experience fitting national condition through analyzing and summarizing the legislative and juridical practice which is about regulation concepts and supervision measures genetically modified crops in foreign countries.In the fourth part: To propose of planting regulation of genetically modified crops.It puts forward solutions from five aspects——establishing scientific regulation idea;improving legal system;establishing regulator to execute legal supervision and management;strengthening regal restriction on scientific research institution and extending regulation channel.As far as I am concerned,the problem of planting regulation of genetically modified crops has been a social focus.It is significant for improving technology and people’s living standard and maintaining national food security to improve legislation system,to raise level of law enforcement and to supervise the plant of genetically modified crops.
