A Study On The Implementation And Improvement Of The Special Inquiry System Of NPC Standing Committee

"Special inquiry" is an innovative measure taken by Standing Committee of the National People’s Congress on the basis of legal supervision form of inquiry. In the aspect of form, it refers to that NPC Standing Committee selects several problems that relate to important livelihood of the country and have drawn the widely concerns of people every year during its annual meeting and carry out targeted inquiry activities by combining the review work. Special inquiry has drawn extensive attentions of all social circles since it was firstly created by NPC Standing Committee in 2010. It becomes "popular" quickly among People’s Congress at all levels with its advantages of easy operation,convenient start and quick implementation etc and becomes a normalized means for standing committees of People’s Congress at all levels to carry out supervision. In recent years, there are some articles that have made researches on special inquiry from different perspectives, but they are not detailed in general. Special inquiry needs to be explored and improved in its status and nature, laws and regulations, operation and execution etc.Since the 12th National People’s Congress, comprehensive and deepening reform has been started up in our country generally. Supervision of National People’s Congress has entered into brand new stage and will definitely play a more practical and important role in promoting the operation and development of the system of People’s Congress. Under this background, it has made deep research on special inquiry, which plays a very important role in improving the actual effect of supervision of National People’s Congress, optimizing the operation mechanism between National People’s Congress and government and strengthening own system of National People’s Congress.This paper takes the special inquiries carried out by state supreme organ of power-NPC Standing Committee as research objects. In this paper, it has traced and summarized the special inquiry of NPC Standing Committee, explored its concept and connotation and analyzed its characteristics and way of operation. In the aspect of practical research, it has adopted "combination of point and line". Besides commenting on the overall situation of special inquiry practice in past years comprehensively,it has presented several sides of special inquiry through several breakthrough points: first, it has taken the implementation situation of the first year after general election of the 12th National People’s Congress in 2013 as example and focused on analyzing the participation situation of members of standing committee; second, it has selected the 2015 special inquiry for the review of vocational education law enforcement inspection report and analyzed the unique relevance of special inquiry, including situation of relevance with other supervision methods as well as relevance between NPC and other institutions; third, it has recorded the field process of 2016 special inquiry for food safety law enforcement inspection report, which has provided subjective perspective for research on special inquiry.Different from most of other articles related to special inquiry, the writer does not only focus on the supervision form, but reflect from the overall supervision work of our NPC Standing Committee. Special inquiry is only a new supervision form of NPC Standing Committee on surface, but if viewing from the big background of our political system reform and development of supervision of NPC, it can be found out that the generation of special inquiry in line with our overall trend; it follows the basic principles of our political environment and system reform in its practice and operation and presents the advantages and characteristics of our NPC system. This paper has drawn following conclusions by analyzing the practice course of special inquiry: special inquiry is the change of NPC supervision from procedural to substantial and is the connection from single supervision method to combine supervision. If we arrange NPC supervision from flexible supervision to rigid supervision, it can be found out that special inquiry is in the middle of the supervision chain, connecting supervisions of different intensities and forms. At the same time, for the presentation of special inquiry, it is with own applicability (or limitation), but also with special functions different from other supervision methods. It is just from this perspective that this paper has pointed out that special inquiry can play a. greater role. Based on the practical situation of NPC’s work, the writer has proposed own suggestions for some places can be improved.
