Reproductive rights are the basic right of citizens,there is a conflict between the national population control purposes and the interests of using the reproductive right,the administrative work of fertility should always take into account the public interest and individual rights.The private reproductive rights which requires adequately respected and protected that the public power shall not overdo the free exercise of the right.By reflecting on relying on the hard law to manage reproductive rights,we found that it is no longer suitable for the development needs of the national population.In the course of the transformation of national functions and the construction of service-oriented government,the concept of law should be changed.The traditional concept of law takes lack of attention to the soft law,it has guidance,softness,negotiation,responsiveness and other characteristics that has a significant meaning to the social governance.China's reproductive rights protection work involves the issue of public governance which are related to the public law.This paper attempts to explain and solve the contradictions by introducing relevant knowledge of soft law.On the one hand,it is necessary to improve the legislative technology of hard law,and on the other hand,we should pay attention to the role of various soft means in the system of reproductive rights protection,and through the combination of the two,we will realize the stable development of our population.
