Research On The Liability Of The Carrier In International Flight Delays

Following the economic integration,the development of the transportation industry is fast.However,the relevant laws and regulations can not keep up with the rapid development of the industry.This leads to the reality of the form is more and more severe,and news about the fight on the plane appears.In the last two years,the People's Daily has reported many similar stories.Whether the news is caused by the imperfection of relevant laws,it is worth discussing and studying.In this paper,I study the legal liability of the carrier in international flight delays.The main part of this paper can be divided into four parts,and there are an introduction and conclusion in the article.They are mainly as follows:I write the reality of the problem caused by the flight delays through the introduction and the necessity of solving these problems to describe the purpose.In this first section,I write about the concept of international flights and flight delays and introduce the concept and key words of the article to pave the way for later study.In the second part,I take the Warsaw Convention and the Montreal Convention as the research focus,and analyse the principle of liability fixation,the reasons for exemption from liability and the limitation of liability.The issues of international treaties are also discussed.In the third part,I discuss how to distinguish the concept of flight delays in the relevant laws and regulations,shoulder the responsibility,and refine the reality of the compensation standards and other issues in the EU and the United States.The problems in practice are also discussed.In the fourth part,I deliberate the status of China's law,study China's existing laws and regulations,considered its actual situation,analyzed its advantages and disadvantages,and tried to give the real legislative proposals.The innovation point of this paper is to try to start from the problems of real life and to study the legal issues related to flight delays with the problem oriented.Under the guidance of the instructor,I study the legal liability of the carrier in international flight delays from the carrier point of view.It is more detailed and specific.The concept of flight delays is discussed.I find out the deficiencies of China's relevant laws through the comparative analysis..At last,I give some constructive suggestions and try to give a feasible solution,such as making clear and measurable standard of compensation and improving the method of delay insurance.
