The Passengers’ Interests Protect In The Case Of Flight Delay

With the development of science and technology, air transport is popular and get’s people’s favor because of its convenient and quick service, but with the development of economy, more and more global air transport lines, restricted by factors such as weather, plus the aircraft flight delay problems stand out slowly, because of the domestic and international researches don’t define the concept of flight delay, so the standard of the flight delay between passengers and airlines have to judge the differences, this also led to the civil aviation act in our country avoid defining the concept of flight delays, only general provisions of the airlines to give flight passengers offset when flight delays happened.,it also makes the compensation for flight delays are according to their internal rules to compensate, this also indirectly led to the conflict between passengers and airlines.The article will be analysis the legal responsibility of the internal legal relations of flight delays. focusing on the concept of flight delays in the perspective of theory analysis and definition of relevant laws and regulations to make a certain degree of evaluation, trying to find suitable law for our country the present stage of economic development of relevant systems. The article consists four parts:The first part is analysis the concept. In the first part of this paper it mainly discusses the theoretical analysis, the concept of the flight delays, the difference of understanding the concept between domestic scholars and foreign scholars, and through my understanding of the concept to determine the scale of this phenomenon.The second part will be analysis the legal responsibility of flight delays. This part mainly analyzes the delays inherent law relations, through the analysis of the legal relationship clear inner link, to provide a strong basis for divide responsibility between the passengers and airlines.The third part introduce foreign related laws and regulations as well as the enlightenment to our country. The third part respectively introduces the continental law system and Anglo-American law system countries on the compensation standard of flight delay and the similarities and differences compare with our country, by comparison try to find out the advantages and disadvantages of our law, to serve as a reference for the construction of the relevant laws in our country in the future.The last part suggest some point to our country’s law establishment of the relevant laws and regulations. Due to China’s current laws and regulations about flight delays is far lagging behind the status of China’s economic development, this part will be make some suggestion to our country’s law systems.
