Study On The Infringement Risks And Avoiding Strategies Of Cloud Music Copyright

The internet music format is undergoing a new innovation based on the cloud computing technology according to its present developing trend.Therefore,the new word-cloud music,appears in the music field.Cloud music can accomplish functions such as the cloud creation,cloud storage,cloud communication,cloud service of music compositions.Users can play the music compositions stored in clouds on-line at any time on any terminal devices with the help of client software of cloud music and experience music everywhere.According to the investigation,the service providers of internet music both at home and abroad invariably offer their users cloud service.It is can be said that the cloud music represents the developing trend of internet music.As a business model,cloud music brings conveniences to copyright managements due to the centralization of the communication channels of works as well as new challenges because of the joint of cloud computing technology.There are four chapters in this paper:Chapter One discusses the concept of cloud music,the basic principles of copyright protection and copyright infringement;Chapter Two investigates the works source,authorization mode and payment mechanism of cloud music in companies such as Baidu,Alibaba,Tencent and Apple;in Chapter Three,based on the investigation,the paper takes two main infringement subjects--cloud music enterprises and users as the research objects,combining with the cloud creation of music,the management,service and consumption practice of cloud music,it discusses the direct infringement risks and indirect infringement risks of cloud music separately;Chapter Four provides the strategies to avoid the copyright infringement of cloud music from the aspects of legislative departments,administrative departments,institutions,enterprises and users based on the discussion of the previous chapter.
