Research On The Registering System Of Sound Trademark

With the economic and social development,communication technology,traffic condition gradually improved,the international trade unceasing development,also causes the trade market competition,the role of the important part as a competitive weapon-trademark became apparent,and begin to present diversification trend,many nontraditional trademark gradually appeared in public view,among them as a new type of sound trademark logo,on the international stage to get the highest importance.In order to in line with international standards,on May 1,2014,the latest revision of the trademark law,article 8 of the regulation sound can be a trademark registration,since then,China has become one of the voice recognition trademark registration country in the world.On May 4,2014,China Radio International announced its application for the registration of sound trademarks to the trademark office,and registered its success in July 2016.From legislative documents,although sound trademark has been recognized as a registered trademark in our country,the legal protection of sound trademark in China but also exists many problems,many rules are not detailed.Sound trademark registered as a trademark into the threshold in the field of law,it becomes more important to study the relevant registration,therefore the perfection of sound trademark registration system,whether it's for the protection of sound trademark subsequent use or infringement has important role.Sound trademark is a kind of traditional trademark,its over traditional trademark have many differences,many of the provisions of the trademark registration is unfavorable and traditional trademark generalisations.Therefore a sound trademark registration problems still exist a certain lack of legislation on the legislation,the existing regulations also there are some defects,need as soon as possible,perfecting laws and regulations.In this paper,by analyzing current status of sound trademark protection in China,put forward the current shortcomings in the aspect of sound trademark registration system,and on some issues compared to model the country or region outside of related regulations,to put forward the corresponding legislative proposals,perfect the system of the voice of the trademark registration in our country.
