The Research On The Infringement Of Personal Information Under The Network Environment

Twenty-first Century .is the information age, the rapid development of Internet technology has enriched and changed the way people save and transmit information. However, when people enjoy the pleasure and convenience brought about by the network technology, we also have a negative impact. At present,the infringement of personal information on the Internet is becoming more and more serious, and even cause the social security crisis of personal information.Personal information network infringement has increasingly become the focus of all countries in the world and institutions concerned, Germany, Japan,the United States and China's Hong Kong region have formulated the special law on the protection of the network personal information. Comparing with those countries and regions, there is still a big gap and lag on the protection of personal information, especially for the protection of personal information on the Internet in China. Therefore, how to carry out a more comprehensive legal protection of personal information under the network environment has become an important task in the civil legislation of our country.Based on the framework of civil law, the use of comparative analysis and value analysis methods, the paper first describes the basic theory of personal information infringement in the network environment. Secondly, introduces the current situation of the protection of personal information infringement under the network environment in China and the existing problems, for example,the direct legal protection of personal information under the network environment in China's indirect legal protection. Thirdly, this paper introduces the legislative mode of the protection of the personal information of the network in the foreign countries and regions, and the enlightenment to our country. Finally, put forward to our country network environment of personal information protection suggestions, establishing the right of personal information, increase penalties for infringement of personal information under the network environment, formulate specific personal information protection law provides more comprehensive and perfect legal basis for comprehensive protection of personal information under the network environment.
