Volunteer service is a noble and great cause.Volunteers who show good qualities such as helping the poor,helping others,are of great importance to promote the glory of human nature and the traditional virtues of the Chinese nation.With the rapid development of economy and society,the scale of volunteer team has been expanding,and the field of volunteer service has been expanding.It has played an increasingly important role in cultivating and carrying forward the socialist core values.According to the latest China Charity Development Report(2016),in 2015,more than 100 million volunteers were registered in China,accounting for 7.27% of the total population.The total number of active volunteers participating in volunteer service was 94.88 million.The Volunteer service as the main body-volunteer service,in the process of volunteer service,free dedication of their own time and energy,does not require the appropriate return.However,in reality,the weakening of the rights and interests of volunteers has gradually increased,and often can not get relief,which greatly hindered the long-term development of China's volunteer service.In this paper,the protection of volunteer rights in China as the core of the study,to explore the concept of volunteer rights and interests related to protection,Based on the concept of rights protection and humanism theory,this paper analyzes the legislation of volunteer service abroad,and draws lessons from its advanced legislative experience in protecting the rights and interests of volunteers,thinks about the main problems in the protection of volunteer rights and interests in our country,and puts forward the corresponding improvement Countermeasure.China's volunteer rights protection of the main problems: First,the volunteer rights protection legislation system is imperfect: the lack of a unified national volunteer service legislation,local laws and regulations of its rights and interests of the protection is not standardized;the second is the protection of volunteer rights The content of the legislation is not perfect: the legal status of the volunteer is not clear,the legal relationship between the volunteer and the volunteer service organization and the service object is not clear;the implementation of the law and the guarantee system of the three volunteers are imperfect.In order to strengthen the protection of the legitimate rights and interests of volunteers,to protect the healthy and long-term development of China's volunteer service,for the protection of volunteer rights and interests in practice,the main problems,from the legislative system to build;improve the legislative content;to strengthen the implementation of laws and protection the corresponding recommendations.First of all,to improve the volunteer rights protection legislation system: the development of a national volunteer service law,standardize local volunteer legislation;second is to improve the protection of volunteer rights and interests of the legislative content: a clear identification of the legal status of volunteers,clearly defined the rights of volunteers And the obligation;Finally,we must strengthen the implementation of volunteer rights and interests of the system: actively broaden the rights and interests of volunteers relief,improve the volunteer rights and interests of the relevant responsibility system,improve the protection of volunteer rights protection measures.
