Study On The Legislation Of Volunteer Rights And Interests Protection In China

In recent years,China's volunteer service has flourished,registered volunteers and community volunteers are huge,and some civil society also recruited volunteers to volunteer,volunteer in poverty alleviation,charitable donation,environmental protection,community service,emergency rescue,etc.Has played an important role,more and more attention by the public and attention.However,the protection of the legitimate rights and interests of volunteers is rarely concerned about the infringement of the legitimate rights and interests of volunteers occurred,which did not cause the public and even the government enough attention.At present,China's volunteer rights and interests are ignored,the main reason for the infringement is the lack of a volunteer service law.Although so far,China has more than 40 provinces and cities to develop their own voluntary service regulations or youth volunteer service regulations and other local laws and regulations,but their provisions on the protection of volunteer rights is too general,too simple or even too principle,the specific implementation is very difficult,not very good results.Accelerating the legislation of volunteer service is the key to solve the problem of safeguarding the rights and interests of volunteers in China.Volunteer service legislation,is conducive to mobilize the enthusiasm of volunteers to participate in volunteer service;is conducive to stengthening the community support for volunteer services for the cause of volunteer service to provide a good social atmosphere;help improve China's socialist security system,accelerate the socialist rule of law Country process.This paper analyzes the local regulations,to find its shortcomings,and draws lessons from the advanced legislative experience of developed countries and puts forward some legislative suggestions to improve the rights and interests of volunteers in China.The full text is divided into the following four parts:The first part is the concept of volunteer and volunteer rights related concepts.Firstly,the definition and characteristics of the volunteers are expounded.Secondly,the definition of the rights and interests of the volunteers is expounded.Finally,the necessity of the legislation of the rights and interests of the volunteers is expounded.The second part is the present situation and existing problems of our country's volunteer rights protection.This part introduces the present situation of our local laws and regulations on the protection of volunteer rights in the form of forms and analyzes the main problems of its existence.The third part is the legislation of the rights and interests of volunteers in developed countries and the enlightenment to our country.This part briefly introduces the legislative situation of the four developed countries on the protection of volunteer rights and interests,and learns their advanced experience and exerts its enlightenment to the protection of the rights and interests of our volunteers.The fourth part is the legislative proposal to perfect the protection of the rights and interests of our volunteers.This part puts forward some suggestions on how to improve the protection of volunteer rights and interests in China from three aspects:legislative model,legislative principle and legislative content,and draws lessons from the advanced experience of foreign volunteer service developed countries in view of the present situation and existing problems of our country's volunteer rights protection.
