An Analysis Of The Settlement Of The South China Sea Dispute From The Perspective Of International Law And International Politics

Since the ancient times South China Sea is China’s territory,whichfrom the Qin and Han dynasties had been discovered,developed,operated,administrated.But since the 1970 s,With the rich oil and gas resources in the South China Sea was explored and the United Nations Convention on the Law of the Sea was promulgated,Vietnam,the Philippines,Malaysia and Brunei which is near the South China Sea began to advocate the interests of the South China Sea and force the occupation of the South China Sea islandsRegardless of China’s opposition,and plunder the South China Sea resources.The South China Seaissue is becoming more and more complicated as the United States,Japan and other countries with various excuses to intervene in the South China Sea issue.It is a big problem placed in front of the Chinese government that how to settle the dispute in the South China Sea peacefully and how to find the right balance between safeguarding national sovereign interests and maintaining good-neighborly relations with Southeast Asian countries.This paper discusses the path of the South China Sea issue.The first part is the introduction of the reasons for this topic,the research significance and the difficulties and the research methods and innovation department are briefly introduced.The second part of the South China Sea and the South China Sea issue was briefly introduced,and then analyzed the current situation in the South China Sea and the status quo,so the connotation of the South China Sea to sum up the analysis of the South China Sea issue has a legal and political dual conclusions,On the proposed South China Sea issue should be properly resolved to adhere to the South China Sea sovereignty to me as a prerequisite,and then from the legal and political point of view to resolve.The third part of the South China Sea sovereignty on my premise of the legal analysis,based on historical facts and international law,reinforce the premise of the legitimacy of the premise.The forth part from the perspective of international politics to clarify the interests of the South China Sea dispute demands for the future to solve the strategy to lay the foundation for political analysis.The fifth part from the legal and political point of view of how China should properly solve the sea problem,and finally concluded: properly solve the South China Sea problem,the need for legal and political means should be applied in parallel,are indispensable.
