The Cultivation Of Legal Belief Theory Of Chinese Society

Legal faith is this proposition by berman in his book of law and religion,in berman’s point of view,the indivisible,law and religion and law requires mutual fusion,and religious law belief formation,to finally realize the value of law.In our country,along with the speeding up of the rule of law society,in order to guarantee the authority of law,scholars in the discussion of the legal faith is also more and more,and for whether need to transplant of law in our country,to ensure the authority of law is the core of the debate.In this paper,through literature analysis,comparative analysis,historical analysis of China’s social law belief culture were analyzed.Based on western legal belief formation theory and studies the historical background,which can implement in our country legal faith to look at,and put forward the feasibility of constructing China’s legal belief.The article is divided into four chapters.Make a basic overview of the first chapter for law belief,and specific analysis of the concept of law belief,characteristics and value;The second chapter for the cultivation of the western legal faith and revelation is analyzed,the development of western law belief has its inherent inevitability and necessity,inevitability and necessity which is rooted in the western natural law and the support of religious belief;The third chapter from the perspective of western legal faith,for the construction of legal faith of our country is analyzed,respectively,from the background,history,rationality,authority,value the five Angle to our country the paradox of law belief;The fourth chapter is discussed from the viewpoint of legal faith regeneration,by combining history and reality of our country is analyzed,combined with China’s specific national conditions,to go beyond traditional legal faith.The formation of western legal faith is not consistent with the existing nationalcondition of our country,in the perspective of western law belief,legal belief cultivation in our country exists inherent paradox.But look consideration from the value of the western law belief and legal belief is the core value of "roots",namely the legal faith of rebirth in China cannot just rely on simple legal transplant,and needs of society in China’s history,tradition,national spirit and deep structure of drain resources,with the traditional civilization order to give new order more connotation and value,and this is the rebirth of our country’s legal belief.
