To make a reasonable exposition on human rights issue in the international protection of intangible cultural heritage,it is necessary to do a proper summary and analysis about the meaning of the intangible cultural heritage,and its characteristics,legal subjects,reasons and advantages for international protection,and so on.The structure and content of this article are arranged from shallow to deep,and it's based on solid foundation.First is the introduction and analysis of basic knowledge of intangible cultural heritage.Analysis of the concept helps to understand the interrelationship between the intangible cultural heritage's international protection and human rights.The legal subjects of the intangible cultural heritage can achieve the docking between rights and the subjects.Through the intangible cultural heritage protected by international activities,it highlights the international responsibility for protection.And it also deals with the relationship between the international protection and the human rights' protection.Mainly argues the interdependent relationship and that the both promote each other,that is:Human rights regulate the international protection activities of intangible cultural heritage,and at the same time,the international protection also echoes the advocacy and maintenance of human rights in contemporary world.The next is about the human rights system in international protection of intangible cultural heritage.According to the applicable time period,it's divided into intangible cultural heritage's human rights review mechanism and human rights supervision mechanism.Before the intangible cultural heritage is incorporated into the international protection system,it's applied the former;after being incorporated into the international protection system,it's applied the latter.The two mechanism types both have their own strengths and weaknesses,they can be complemented by each other,and make up for each other to form a clear organic whole.Based on this,it will discuss the conflicts of human rights that are encountered in international conservation efforts and analyses the causes of these conflicts.Those problems can be alleviated or solved by drawing on the settlement principles of the rights conflict in international human rights law and the way of coordination.
