Research On Public Warning Legalization In Food Safety

Public warning as a new type of administrative supervision activities,it refers to the administrative organs of the potential or have occurred in the food safety issues issued to remind the public to pay attention to prevent it,do not have a direct force,the main results depend on the public response and cooperation.In the field of food safety problems,due to the limitations of traditional administrative means,the administration tend to use public warning release risk information to the public,on the one hand,it can protect health and safety of the public,On the other hand,can also realize the purpose of supporting the administrative regulation.However,the legal provisions relating to public warnings do not provide clear rules about release condition,release procedures,and relief,so that the publication of public warnings of food safety tends to be in a state of chaos,due to food safety issues for the public is very sensitive,they have zero tolerance about it,once the administration issued a public warning of food safety,the public will have their own attitude,they resist the relevant food enterprises spontaneously,if the public warning content issued error,it will cause different degrees of damage to the relevant food enterprises,some companies even suffered devastating blow.Therefore,study the release of public warning,analyze its problems in the application process,based on the existence problems of the public warning to propose legal recommendations,in order to continue to improve the existing laws and regulations,and the administration have a more clear legal basis to issue a public warning,the relevant food production enterprises for the wrong public warning will obtain legal remedy,and protect their legitimate rights and interests on the greatest degree.Based on this,this paper is based on the public warning of food safety as a research object,point at the problems existing in the process of public warning in the field of food safety,some feasible suggestions are put forward to regulate the publication behavior,maintain the government credibility,protect the legitimate rights and interests of the enterprise who suffered serious losses due to false public warnings.
