Research On The Criminal Law Of The Crime Endangering Food Safety In China

Food is the paramount necessity of people and food safety is the priority.In order to supervise food safety effectively,guarantee health of people,besides emphasis on regulation on food safety from the perspective of administrative supervision,each country also focuses on regulation over food safety from the perspective of criminal punishment.In the meantime,it should be known that the food safety situation is still severe in China.There has been consensus about social collegiality and emphasis on governance ranging from the central government to common people.In aspect of measures and means of emphasis on governance,criminal law plays an important role of cracking down on crimes.During the period,there are many problems in need of discussion no matter in promotion of legislation,improvement of enforcement,and application of jurisdiction,which makes food safety become increasingly the focus on criminal theory field and practice field.The topic explores related problems to food safety crimes from the criminal perspective.The thesis consists of introduction,text and conclusion.The text includes the following parts: the first part introduces its concept and features;the second part makes brief introduction about legal regulations of food safety crimes from the perspective of legislation regulation,legislation values,and principles.The third part makes brief evaluation on China from the perspective of legislation regulations,values and principles.The fourth part makes comparison of related legislation regulations between China and main foreign countries and discusses the insufficiencies and reference of related legislation in China and foreign countries.The fifth part explains and explores the difficult problems and classical cases of judicial application involved with three direct crimes in Amendment to Criminal Law;the sixth part improves thinking about food safety crimes and proposes perfect suggestions about legislation problems about direct crimes of three food safety crimes involved with Amendment to Criminal Law.Above all,the thesis expects to contribute to Chinese food safety legal construction based on the discussion about the above contents.
