In recent years,with the popularity of Internet use and online payment,people has changed the traditional trading mode,e-commerce has become a new business model and previous transactions in different ways,it becomes a contemporary international business and economic activities of the mainstream transaction.Europe and other countries due to the emergence of electronic commerce time early,at the forefront in the legal regulation of the third party payment.It is worth paying attention to the development of China on-line payment legislation lags behind the market.In the existing law,the on-line payment legislation is lacking,only some departmental rules and policies,legislative effect level is low,but attention mainly focused on the regulation of banks and enterprises and online banking.On the legal status of the third party payment,many problems were not as regulatory legislation.Therefore,the research and improvement of national legislation and according to legal provisions in the field of China third party payment is necessary.In this paper,based on domestic and international research results,the concept of third-party payment platform,advantages and disadvantages of a brief introduction,while the third-party payment platform to participate in the analysis of the main and legal relations;Second,China's e-commerce platform for third-The third-party payment platform in our country has a big loophole in the law;Finally,draw lessons from the successful experience of the United States and the European Union,put forward the proposal that is helpful for perfecting the legal regulation of the third-party payment platform in our country and Countermeasures.
