Study On Current Lawsuits Status,Problems And Enlightenment Of Medical Disputes In Some Three-A Hospitals Of Chongqing

ObjectivesThe study is based on the combination of macroscopic theories and concrete technologies.On one hand,the study reviews related theories about medical dispute lawsuits and summarized the advanced experience at home and abroad.On the other hand,through the research about the litigation cases of some three-A hospitals in Chongqing from 2009 to 2014,the study analyzes nearly six years' litigation situation of medical disputes and find some problems in the process.At last,in order to just and reasonable solutions about medical disputes and harmonious doctor-patient relationship,the study finds some feasible countermeasures,combined with the present situation of Chongqing.MethodsFirstly,use literature analysis to query related literatures about present situation of medical dispute lawsuits at home and abroad,and focus on the present situation of domestic medical dispute lawsuits after the tort liability law is promulgated.Secondly,have expert interview to consult relevant experts,including related department personnel,staff dealing with disputes and senior lawyers and so on.Lastly,analyze 404 cases of some three-A hospitals in Chongqing to discuss existing problems in litigation,effect of the tort liability on medical dispute lawsuits and the dispute focus.ResultsThe development experience of foreign medical dispute lawsuits and general situation of domestic medical dispute lawsuits was summarized for the significance of reference to medical dispute lawsuit in Chongqing.Present medical dispute lawsuits were probably understood in Chongqing,through the statistics and analysis.Some problems about medical dispute lawsuits were found in the specific process in Chongqing.The countermeasures and enlightenment to solve the problems about medical dispute lawsuits was put forward,combined with existing research.ConclusionsThrough literature reviews about medical dispute lawsuit at home and abroad,expert interview and analysis of judicial documents,the development experience of medical dispute lawsuits and present situation of medical dispute lawsuits in Chongqing was mastered.So some feasible suggestions could be put forward to improve the situation of medical dispute lawsuits in Chongqing,based on medical institutions,medical evaluations,and medical litigation as the main body.
