Subsidiary Information And The Objective Authenticity Judgment Of The Evidence

With the further development of the economy, science and technology, there is a new trend in theoretical research of the evidence. Compared with the traditional theory, the using of research evidence relevant knowledge of information theory gradually highlights its unique advantages. As we all knows, the features of evidence include legality, relevance and facticity. The first feature focuses on the form, the second means that the evidence is closely related with the facts which to be proved. And the last but not the least emphasizes the authenticity of fact or content in the evidence is real, not imaginary or subjective. The judgment of the objective truth of evidence must be established on the basis of fully mastering the subsidiary information, because of the types and characteristics of the subsidiary information affect the objective truth of the evidence. The subsidiary information even plays an important role in kinds of evidence, different stages of litigation and evidence review. So, the subsidiary information is the key to the objective authenticity of the evidence, and it has research value.This dissertation based on the materialist dialectics theory, and combined with information on the frontier research, which by objectively analysis the intrinsic link between subsidiary information and the judgment of objective truth of evidence to exploring the influence of the objective truth of evidence. For this, the subsidiary information is the key point of the objective truth of the evidence, and I divided the types and characteristics of the subsidiary information in details. The thesis consists of six chapters, which are divided into three parts: the first part is the first chapter and the second chapter, the second part is the third and the forth chapter, the last part is the last two chapters. In the first part, I mainly expound the concept, characteristics and research value of subsidiary information. The second part I mainly review of the theory of objective authenticity controversy, and clarify the concept of truth, extended out of the impact of information on the objective authenticity. In last part, I summarize the subsidiary information’s methods and rules in the objective authenticity judgment of the evidence.
