With more Chinese corrupt officers fleeing the country,new challenges were brought to the anti-corruption and trailing fugitives work.Extradition is a common mean and method used in trailing fugitives and has become the preferred option for trailing fugitives due to its strong stability.Canada is the main targeted country for trailing fugitives but has not singed the bilateral extradition treaty with China.Therefore,it is essential to compare and study the differences of extradition system and laws between the two countries.And it is believed that this study is meaningful for improving China’ s extradition policy system and will provide a useful reference for the signing of bilateral extradition treaty between the two countries.This paper has four parts:first of all,an introduction on the features and status quo of Chinese anti-corruption work will be made;secondly,an analysis on the difficulties of current anti-corruption and trailing fugitives work will be conducted with the aspects of extradition system deficiencies,domestic legislation defects,judicial environment and so on;the third part is about the cooperation status quo of china and Canada on the issue of trailing fugitives,and the similarities and differences in two countries’ extradition system in the aspects of entity and procedure.The question of on what aspects can the two countries learn from each other will also be discussed in this part;finally,suggestions will be given on improving our country’ s extradition system from the aspects of legislation at home and abroad,propaganda of laws,personnel Constitution,alternative measures and evidence system.
