Research On The Classification Of Rumors Regulations

Rumors as an ancient media,in the contemporary era of the Internet era,has produced new features,that is,compared with the traditional rumors,the breeding of a fast,wide range,anonymity and other characteristics of the new network rumors.The Network rumors are numerous and diverse,but not all of them are objects of legal restriction.The law needs to punish only low-value statements that adversely affect individual interests,social welfare,and national security.At the same time,we should also realize that the rumors of the network is the expression of the right to freedom of expression.As a kind of collective expression,it indirectly reflects the social and public sentiment,which helps the citizens realize the right of information and supervision and urge the government to carry out the information disclosure.Therefore,the law in the regulation of network rumors should be to protect the freedom of speech for the value orientation,to avoid severe penalties caused by the "chilling effect" consequences,violations of the people's freedom of speech.Based on the connotation of rumors and network rumors,this paper uses the method of comparative study to analyze and compare the definition of rumors in China and the West,and draw the connotation concept of rumors,and then put forward the rumors of the network has high value and low value.As well as the favorable value of the rumors of the network,to explore the theoretical support of the legal regulation of the network rumors,and to distinguish between the different standards of the rumors of criminal law,administrative law and civil law.Finally,from the legal level analysis of network rumors as a social problem should be how to be treated measures.
