Improvement Of Mediation System Of Administrative Litigation

At present,the law has clarified that the mediation of administrative litigation applies to the settlement of administrative disputes.The mediation can also be used in the government's decision on compensation for land acquisition.However,in practice,the lack of specific procedures makes the mediation of land compensation facing more obstacles.Therefore,this paper aims to seek the value of administrative litigation mediation through the view of compensation for land expropriation.The writer wants to make a contribution to the mediation system of administrative litigation and further make suggestions in solving the missing of mediation procedure question.Whether the administrative compensation of the expropriated person is not the final pursuit of the court,it is the intention to supervise the administration organ according to law and to safeguard ' the fundamental interests of the expropriated person.In actual life,land expropriation compensation exists of a variety of physical defects and procedural defects,showing that such litigation cases need to be resolved through mediation.And the grassroots court which already used mediation as a method to solve such cases,as well as the theoretical support,adds the feasibility of applying mediation in compensation for land acquisition.Therefore,through analyzing the process of mediation of compensation for land acquisition and further carrying out questions,the problem can be solved by making up for its shortcomings.At last,we will improve the mode of mediation of compensation for land expropriation and mediate the relevant procedure.At the same time,the flaws of the land compensation mediation can be relieved,and a sound mediation model can be established.
