Research On Genetically Modified Foods Labeling Legal System In China

Since the end of twentieth Century,genetically modified technology has developed rapidly.Scientists have applied this new technology to the field of crop breeding,There are plenty of crops which have advantages in disease resistance,stress resistance,nutrient composition,appearance and other characteristics.In normal circumstances,Most of citizens can hardly distinguish which ones are genetically modified food(GMF)from the numerous food varieties.And due to the unknown risk of genetically modified food,Most of the countries take measures to manage GMF.GMF labeling system is one of the legal systems of GMF regulations.In China,the institutions of GMF management seems not functioning well and some relative rules and laws,which have formed since 2002,also encounter many problems and challenge.Under this background,its urgent that we should improve the relative regulations,through analyzingThe regulation of GMF systematically,summarizing the problems explored and referring to experienced and established regulars abroad.This article is about analyzing the existing problems of GMF labeling system,improving the regulations of GMF systematically,and the establishment of monitor department,and making sure that the labeling regulation of GMF works well in safeguarding the civil rights,maintaining economic orders and sustainable developmentThis paper is divided into five parts.First,introduce the concept of safety of GMF and the labeling system.On this basis,the author will expound the significance of the GMF labeling system.Secondly,Introduce the situation of the regulation of GMF in our country,which including the rules and regulation in relevant laws,the setting of institution,and the juridical practice.Then,Summarize the flaws of GMF labeling system in China from three aspects as follows: In the legal standard aspect,the main problems are the ones which have defects in its content and form,recognizing the GMF,lacking of non-GMF regulations and the standard of threshold;And regulators which have fault in labor division and government information disclosure;In the aspect of juridical practice,it seems difficult to protect the basic civil rights through labeling litigation.Besides,after comparing the regulations in EU and America,we have the conclusion that when to enact the laws and regulations,we should take our basic national conditions into consideration,set up regulators with clear labor division and combine the regulation of labeling system with the traceable system.At the last,our country should perfect labeling system in the relative aspect,such as updating labeling Catalog,abundant the GMF label's content and form,adding the regulations of ”non-GMF” and traceable label,setting the standard of threshold;as well as perfect supervision mechanism in aspect of labor division and government information public system;Above all,on the basis of appropriate regulations and rules,we could apply public interest litigation system in GMF labeling lawsuits.This article summarizes present problems of GMF labeling system in our country,learning from other researches and the regulatory experiences abroad.With all the measures mentioned above,the mean purpose of this paper is attempting to put forwards some suggestions to GMF labeling system,in order to make it function well in GMF supervision.
