Technology continues to develop,and Internet is becoming more and more mature.Electronic payments have entered the era of prosperity.Consequently,the third-party payment came into being.Because of its high efficiency,convenience and other advantages,the third party-payment is favored by people,and gradually replaces the traditional way of payment.It not only has become an important tool in people's daily lives now,but also plays an important role in promoting China's economic development.However,with the increase of users,the risk caused by the third party-payment has also attracted people's attention.Because of the objective existence of time difference in the transaction process,money will strand in the third-party payment's platform for a few days.This forms provisions that this paper is studying.Since twentieth Century,the third-party payment has begun in our country.Now,the development of the industry itself and the government regulation are not mature,resulting in many problems in the development process,provisions is one of the important issues.If the provisions are not effectively managed,it will infringe the legitimate rights and interests of users,but also bring financial risks to the community.Therefore,the funds and high interest should be owned by who,how to use the money,and how the government should supervise these issues are worth considering.This article from the legal perspective,through analyzing the current management regulations about provisions,to explain the current problems that exist in the provisions.Meanwhile,drawing lessons from the mature experience of the United States and the European Union in practice,and put forward relevant proposals from the legislation,law enforcement,law-abiding three aspects to improve our country's provisions system.
