Study On The Interests Protection Problem Of Credits On The Process Of Bankruptcy Reorganizat

With the promotion of the world economy,the knowledge economy in our country also entered into a period of rapid development.The market competition is increasingly fierce,which makes the development of some enterprises meat practical obstacles and will face the risk of bankruptcy.The enterprises will choose the better method to solve tough problems existing in its development process when the bankruptcy reasons appears.The implementation of the new Bankruptcy Law makes reorganization system greatly applicable,which brings the flush of hope for enterprise's reconstruction and provides possibility for creditors to gain full credit's repayment.But the application of the law isn't going smoothly.Many regulations are not perfect enough,especially the creditor's right protection is still moving forward in the exploration.The interest entity is complex and complicated in the expertise reorganization,especially the creditors have to quit their own rights or interest in advance.Yet the related enterprise will transfer asset and procrastinate debt naturally or half unconsciously,which makes it difficult for protection of the creditor's interest to get relief.This paper consists of three parts,The introduction,text and conclusion.Combined with the implementation of bankruptcy law in practice in our country.The article discusses the enterprise reorganization system and the reasons of reorganization also makes a analysis and study for each stage's present condition and existing deficiency in our country's bankruptcy reorganization procedure at present.Then the corresponding construction measure can be put forward according to these deficiency.
