The Custody System Of Criminal Evidence

The scientific custody of the collected evidence is the key link to ensure the success of the criminal proceedings.Therefore,it is helpful to establish the comprehensive criminal evidence custody system to regulate the investigation and prosecute the custody of the evidence.It is helpful to find out the truth and maintain the parties legitimate rights and interests,to promote litigation fairness and justice,improve the efficiency of litigation,effectively prevent the occurrence of miscarriage of justice.This paper in addition to the introduction and conclusion,in four parts of the criminal evidence custody system analysis are set forth as follows:The first part is an overview of the criminal evidence custody system.This paper mainly analyzes the criminal evidence custody from the aspects of concept,function and so on.It analyzes the relationship between the criminal evidence custody and the chain of custody of criminal evidence,and introduces the content and function of criminal evidence custody system.The second part is to introduce foreign countries on the criminal evidence custody related system comparison and reference.Through the United States and other legal countries developed criminal evidence custody of the relevant provisions and practices of comparative study,summed up the lessons learned from its successful experience.The third part is the present situation and existing problems of criminal evidence custody system in our country.Focusing on the practice of criminal evidence custody practice,including the custody of the main body,custody and other aspects of the existing problems,and analyze the causes of the problem.The fourth part is to establish a perfect criminal evidence custody system which conforms to our national conditions.Advocated through the improvement of legislation,organization,personnel composition,operational guidelines and a series of system norms,in line with China's national conditions of criminal evidence custody system.
