The South Sea of China,abundant in diverse resources covering a large expanse,is of critical political status and commercial value,due to its critical nexus linking the Pacific Ocean and Indian Ocean,and its witnessing above 50%of vessels across the globe to proceed through the South Sea of China.In the long term,China,as a big inland country,has given limited input to the development of marine industry,which has resulted in severe violation of China's legitimate rights and interests and maritime safety in the South China Sea.To safeguard the territorial sovereignty in the South Sea of China and China's legitimate marine rights and interests,the 18th CPC National Congress in November 2012 initiated the significant strategy of building a marine power.In 2013,the Chinese government integrated five departments related ocean affairs into two departments,leaving behind China Coast Guard and China Maritime Safety Administration with different emphasis.Making a comparative study of maritime safety administrations in developed countries and domestic departments related to ocean affairs,the author has held the view that there is still space for a better system and mechanism in China's maritime administration;it is essential to enhance laws and regulations concerning maritime administration and strengthen informatization,intelligence and line-up of equipment for maritime law enforcement.The thesis aims to study the capabilities of the South Sea of China Division for the Marine Patrol and Law Enforcement of China Maritime Safety Administration in marine patrol and law enforcement,a major administrator for marine patrol and law enforcement in the South Sea of China,and analyzes six elements undermining capabilities in marine patrol and law enforcement in the South Sea of China,including the setting of maritime administrations,reform of system in maritime administration,equipment allocation for marine patrol,evaluation system of marine patrol,enhancement of laws and regulations in maritime administration,and concrete system of maritime and aerial patrol.The author analyzes existing problems by employing theories of new public management,limited governance,and public economics,and proposes suggestions to upgrade marine patrol capabilities of the South Sea of China Division for the Marine Patrol and Law Enforcement of China Maritime Safety Administration by drawing experience of such developed countries as USA,UK and Japan in maritime administration.
