The Commentary Of The Signature Handwriting Identify Opinions And The Wrong Identification

Handwriting identification is regulated by the Civil Procedure Law as one of the types of statutory evidence,as scientific evidence.And,handwriting identification as a forensic technology has its own particularity,which is more prone to errors than other identification techniques.On the basis of confirming the scientific and proof force of the appraisal,this paper makes a more in-depth discussion on the concept and identification of signature handwriting.The article mainly uses the signature handwriting appraisal opinion in the civil procedure application as the angle of view,and discusses the application of signature handwriting appraisal and its opinion in civil litigation from the evidence,cross-examination,certification of three links.Firstly,it introduces the concept and development of signature handwriting,and then leads to the identification of signature handwriting.It summarizes the particularity of signature handwriting identification,and the problems existing in signatures of civilized litigation.Finally,it analyzes the reason of misidentification opinion in signature identification and how to judge.This paper is divided into five parts:The introduction is an overview of the special thing about handwriting.On the basis of elaborating the origin and development of handwriting,the paper puts forward the question of the acceptance of handwriting.The first chapter summarizes the characteristics of handwriting and the characteristics of signature handwriting,and fully explains the concept and characteristics of signature handwriting.The second chapter summarizes the particularity of signature specialization.First of all,it briefly explains the theoretical basis of signature handwriting identification,emphasizes the integrity of the theoretical system of signature verification in China.In this paper,the signature handwriting is divided into normal signature handwriting,camouflage signature handwriting and forged signature handwriting three categories,respectively,summed up the characteristics of these three types of handwriting identification and the value of identification.The third chapter about the signature of the handwriting identification is the focus of this article.First of all,this article from the point of view of civil litigation,signed the handwriting identification as evidence of a kind,should experience the court evidence,cross-examination and certification process.Secondly,it analyzes the current situation and existing problems of the current opinions on the handwriting identification in China.Thirdly,the expert witness system related to the common law system and the appraisal opinion is compared with the authoritarianism adopted by our country,indicating that the two have their own strengths.Finally,a simple idea is made on the review and acceptance of the handwriting appraisal opinions in China.The fourth chapter——the misidentification of signature verification and its prevention is the reinforcement of the third chapter.As the signature handwriting identification is prone to false identification,so we need to make an objective evaluation of the error,according to which can clear the wrong and accountability.Therefore,this chapter,based on the analysis of the causes of the mistakes of the signatures,provides a corresponding way to prevent and control the error.The purpose of this paper is to enhance the credibility of handwriting appraisal opinions in litigation practice and give full play to its role as evidence to prove the facts of the case.This is also the foothold and destination of this paper.
