Research On Legal Risk Prevention Of International Railway Freight Forwarders

This research paper has two major purposes:one is to investigate the legal risks in the rail freight forwarding industry and to demonstrate risk preventions.In general,the author analyzes the definition of rail freight forwarders,the specific terms of railway transportation contracts.How the legal status of rail freight forwarders and carries are addressed in terms of their operations.How the characteristic of railway transportation differs from other transportations.The international rail freight forwarding is an emerging industry with the rapid development of international rail freight transport;initially international rail freight forwarders were acting as mere agents,with the advent of multimodal transports and worldwide containerization of goods.Due to its rapid development,the international rail freight forwarders were engaged in a wider range of businesses.However,the identities of the parties in business operations were getting complex in bearing the responsibility in case of breach of contract.In the involvement of the international freight forwarding business,it is coercive to establish the legal status of international freight forwarders and its partners to determine the corresponding responsibilities and obligations.In this paper,the author analyzes the problems existing in the international railway freight forwarding industry and combines the relevant international laws and regulations to disclose the possible risks of the international railway freight forwarding industry.The main legal risks are analyzed and targeted.Put forward the measures of risk prevention,hoping the international railway freight forwarding industry have something learn from to avoid legal risks.The paper is divided into six chapters:Chapter 1:Briefly introduces the research background and significance of the paper,and summarizes the research contents of this paper.Chapter 2:Mainly describes the description of the definition of international railway freight forwarders,and also introduces the characteristics of international rail freight transport,further studies the functions,significance of international railway freight forwarding industry and analysis of the problems in the development of International railway freight forwarders.Chapter 3:Summarizes the legal risks faced by international rail freight forwarders.Chapter 4:This chapter mainly deals with the legal issues of international rail freight transport and the related research on the?Agreement Concerning International Carriage of Goods by Rail?.In addition,there is a relationship between the international railway freight transport with the carrier liability issues and the international railway cargo intermodal conflict and solution to carry out research.Chapter 5:Selects classic case of international freight forwarding,with a view to more intuitive interpretation of legal risk.Chapter 6:Presents a proposal to circumvent the events that may be encountered when dealing with international rail transport international rail freight forwarders in the event of problem processing.Puts forward the measures of risk prevention,hoping the international railway freight forwarding industry have something learn from to avoid legal risks.By the nature of their work,international freight forwarders face series of legal risks from internal and external sources.Therefore,in order to reduce operating costs and maximize profits,international rail freight forwarders must have a systematic analysis of the legal risks of the industry and target to do a risk prevention work.Finally,the author analyzes the relevant laws,puts forward the measures of risk preventions,hoping that this research paper will help the international railway freight forwarding industry to avoid legal risks have a legal understanding of their operation to learn from.
