Approval System Study On The Legislation Of China National Regional Autonomy

Our five autonomous regions haven't come up a autonomy regulations which is made by the autonomous region so far.The lack of legislation was caused by many reasons.One of the most important reasons is the approval system of the legislation of China National Regional Autonomy.The topic of this article is the approval system study on the legislation of China National Regional Autonomy.The first part is the overview of the approval system of the legislation of China National Regional Autonomy,including the legal principle,legal basis and operation system of it.The second part is the state of the approval system of the legislation of China National Regional Autonomy.First,it was described by empirical data.Then,the autonomy regulations made by Guangxi Zhuang Autonomous Regions was used as an example to analyze the legislation of China National Regional Autonomy.The third part is about the problems of the approval system of the legislation of China National Regional Autonomy.First,the relevant laws and regulations are inconsistent and the meaning and nature of the approval system are not clearly defined,leading the legislative approval mechanism,to some extent,lacked legitimacy foundation of self-government.Second,lack of approved standard entity made the autonomy can't be ensured.Third,approval procedure does not comply with the requirements of due process,resulting in ethnic autonomous legislation can't be fully guaranteed.Fourth,the subject of approval lacked professionals and specialized agencies,which made it hard to complete for substantive review of the National Autonomous legislation.The fourth part is the preliminary suggestion on how to perfect it.The recommendations are as follows: first,perfect the legislative system of ethnic regional autonomy and explicit the range of the approval process.Second,perfect the approval process,that is to say,explicit the meaning and term of the approval process.Third,try to set a special review institution and a supervisory organization of Autonomous Legislation.Last,based on the improvement of the approval system,build a record system instead of the approval system when the time comes.
