A Study On Administrative Law Enforcement Of The Punishing Illegal Medication In Beijing Fengtai District

The concept of illegal medication is relative to the concept of legal practice,generally refers to the behavior of people who do not have medical qualifications,or in violation of the provisions of the state health in medical activities.Common "illegal clinic",is currently the focus of the health administrative departments to punish.The formation of illegal medical practice both historical reasons and social reasons.Punishing illegal medication and maintain the order of the medical market,has always been one of the important work of public health.This paper takes Fengtai District Beijing as an example,analyzes and studies the administrative law enforcement of illegal medication.First of all the step of punishing illegal practice in Fengtai District and some results achieved are briefly introduced.Secondly,the relevant literature on the domestic and foreign are discussed.Thirdly,the concept of illegal medication and the responsibility of the health administrative departments are clear and definite;the key of punishing illegal medication is to combat unlicensed medical practice.Fourthly,to Fengtai District in 2010 to 2015,5 cases of medical complaints and treatment are analyzed,and the reason of five characters of medical complaints is discussed.Finally the paper gives five countermeasures to punish unlicensed medical practice.Through in-depth analysis the reason of the long-term existence of illegal medication,the status of illegal medication and the case of law enforcement,regulatory issues,and the application of the law for administrative law enforcement departments in the treatment of illegal medical medication,the paper provide reference for further improving the supervision and administrative law enforcement of unlicensed medical practice.
