Establishment Of Resale Right In China

In 1920, The system of Resale Right was established in French for the first time?More than 80 countries have established the system after a nearly century. Resale Right is absorbed into the copyright law system in our country during the copyright law be revised for the third time,which causes widespread controversy. One of the controversy is the feasibility of establishment of Resale Right,another one is how to establish it. This paper depends on the analysis of Resale Right, combined with foreign legislation experience and make analysis on the specific building of Resale Right in China.This paper is divided into three chapters, theoretical analysis-Legislative Reference- System Design.The first part is the theoretical basis of Resale Right. This part focuses on the concept and nature of Resale Right, then analyze the legitimacy and significant to our country.The second part is the investigation of Resale Right abroad. This section examines the system of Resale Right in the two legal systems(common law, civil law) and international treaties, and analyze its reference significance to our country.The third part is the establishment of Resale Right. Combined with the definition of Resale Right, put forward the method to build it.
