The Protection Of Photography Copyright In Internet Environment

With the rapid development of the information technology and the cultural industry, the copyright infringement of photography in the network comes. For protecting legitimate interests of copyright owners, the author takes the copyright protection of photography as study objects. The text is mainly composed of three parts:The first part: on the one hand, the meaning, classification and related characteristics are summarized on the basis of research results from relevant laws,scholars and predecessors; on the other hand, status quo of photography copyright protection by the current legal system, with the analysis and research about typical cases of photography copyright infringement in the judicial practice.The second part: the deficiency of copyright protection about current photography is summarized on the basis of above study, and photography copyright issues are analyzed through the proper use and the creative decision criteria.The third part: suggestions of perfecting network environment are put forward by summarizing actual problems of the photography copyright protection in China. And corresponding system-construction thoughts are put forward from the system level,the system-construction of collective management, the perfection of specific provisions about technical measures and laws and the perfection of fair use system.The author expects to contribute to the judicial protection of photography copyright in a new era, through an in-depth study and discussion about photography copyright's protection system under the network environment.
