Research On The Post-evaluation Of Local Legislation In China

As a new thing in the process of building the rule of law in China, especially after the formation of the socialist legal system in our country, post-evaluation of local legislation is still need to be perfected. Along with the further development and perfection of the legal system, we need to improve the quality of local legislation system, especially in the improvement of the China’s local legislation. Post-evaluation of local legislation, as an important means of improving the quality of legislation, since it was introduced, has played an increasingly important role, there have been more and more practice and theoretical exploration and theoretical circles, it has been accepted by most of the scholars and supporters. However, with the development of post-evaluation practice of local legislation, some defects appears.The lack of standardization of the post-evaluation, disorders of the assessment procedures, old methods to the establishment of evaluation system of local legislation in China has brought a certain degree of obstruction. Post-evaluation system of local legislation requires the infusion of new blood, to update our post-evaluation of local legislation conscious to make our post-evaluation system a comprehensive post-evaluation system of local legislation.For the constantly problems, basing on the study of the post-evaluation of local legislation, introducing the beneficial experience of the developed countries, we put forward some useful explorations. After the analysis of the assessment subject, object, method, program, some useful treasures has targeted to respectively solve the problems. To create a unified legal system to unify the practice of post-evaluation is essential, and it is necessary to institutionalize the post-evaluation of local legislation.
