Research On The Power Of The Government Listing

Since the “Power Lists System” was put forward in the Third Plenary Session of the 18 th Central Committee of the Communist Party of China, it has been widely spread and implemented by local governments. As a key step of government's power operation, “power lists system” plays an important role in the process of impelling government power's opening and transparency. Besides, it is an essential means of transforming government function and building a service-oriented government. However there are still some problems in the primary stage of “power lists system” in our country, such as the absence of unified standard for its structure and contents, the singularity of the policy making main body, and the lack of supervision mechanism, etc. As for the contents of “power lists system”, it is necessary to set a series of unified standards to avoid the arbitrary division of power. From the perspective of the main body of the makers of government power lists, they should distinguish the subject of establishment and implementation and set up a multi principal mechanism which is combined with the National People's Congress, the government experts, scholars and the community collaborative. On the legal effect of the “power lists system”, only if these are clearly characterized as normative legal documents, could they really work. Finally, it is urgent to improve the supervision of the government power list system and to make a clear supervision of the main body and give the most extensive supervision to the citizens and the society. Further more, it is urgent to make a step forward in improving the development of the accountability mechanism and make sure the supervision process is running smoothly. Thus establishing a perfect system of government power list is helpful for the promotion of the rule of law government and the rule of law society.
