Study On The Determination Of The Cause And Effect Relationship Of Ecological Damage Civil Liability

The problem of civil liability,which causes by ecological damage,is a very serious problem of environmental law,and it is desire to pay more attention to the basic living conditions and human action elements according to the current laws and regulations such as "Civil Law","Tort Liability Act".Nowadays,the responsibility of environmental pollutant is the most difficult problem of social stability and economic development,and it is the inevitable result of the social concern and discussion.Ecological damage is a new academic title with the environmental damage issues,and the responsibility of the ecological damage cannot be determined from the original point of view to make a reasonable judgment.At present,the definition of the responsibility of ecological damage is still in an unknown state,and the problem of the civil liability of the ecological damage is in the blank and the great controversy in theory and practice.Only the relevant provisions of the tort liability act cannot adapt to the current civil liability of ecological damage,but also the current legislation is not perfect and the policy cannot implement the crux of the problem.Therefore,the author will focus on the system analysis of the traditional theory of causal relationship in the application of ecological damage to the responsibility of civil liability system defects and theoretical problems,the study of the tort liability in civil liability in the identification of causal relationship.The article intends to pass the following six parts,the research on the identification of civil liability of ecological damage:The first part is the introduction.In the second part,the paper analyzes the basic problems of the civil liability of ecological damage and the identification of the relationship between the civil liability of ecological damage.The third part discusses the theory and the system construction of the civil liability of ecological damage.The fourth part discusses the theory of the foreign ecological damage civil liability causality and the feasibility and deficiency of the theory of reference and identification of the current ecological damage cause and effect relationship.The fifth part puts forward the specific identification system.
