Improving The System Of Police Shooting Terms In Our Country

Police as a part of the national agency of violence, their duty is protecting people and maintaining social stability. With the constantly expanding of the public power, the police power is exactly playing a good role in society, but at the same time, it also begins to threaten the basic civil right. In China, the special background is the disintegration of urban and rural structure,which lead to friction and conflicts between different interest groups. When criminals are conducting illegal act,they may be chose more dangerous criminal tools.The result is that the police will chose some harsh police equipment to uniform criminals. In recent years, more and more police shooting cases also confirmed present situation. Through analyzing some typical cases of police shooting in our country, I am trying to find out a equilibrium point between Police Power and Civil Rights.In our country,the establishment of the police power system is very late.Because of the lack of experience and consciousness of law, it is very important to learn lessons from the related legal system of other countries. Focusing on the practices of foreign police shooting system and drawing its essence which is suitable for national conditions of our country, we can try to put forward a suggestion improving the legal system of our country. At the same time, we should reflect on the system of police shooting conditions, and put forward the possible system construction and theoretical development direction. This article covers four parts:The first part sorts out the laws and regulations of the police shooting conditions, and finds out shortcomings and problems which caused by these regulations.As follows: First, the current legal system is lacking of speciality, the police shooting terms are not detailed and professional enough,which lead to the high probability of police abusing or improper using shooting right. Second,the procedure of police shooting is imperfect.Thirdly, the lack of a sound system of supporting the use of firearms, especially in the police and the media communication mechanism and the police vocational skills training mechanism.The second part is the summary and analysis of the foreign legal system of police shooting, using three countries as examples. This paper mainly introduces the legislative background, judicial technology, specific legal system and the supporting system of the gun firing system of these countries. Through the interpretation of these countries’ related system, in order to find out a suitable system for China’s national conditions.The third part puts forward some suggestion to improve the legal system of police shooting terms in our country. There are three parts: First,we should affirm the principles of Police shooting regulations.These principles are convenient for us to understand the aim of legislation.Second,the legislature should draft a special law to regulate police shooting power and enhance the legislative level from in form and refine the terms.Thirdly,improving the gun support system is important. Shooting right is the highest level of the use of firearms, the law can not be independent of the gun support system. The gun using support system plays a role of "logistics support", and it is important to maintain the benign operation of the police shooting power.
