Study On Bullying Behavior

Bullying refers to the students,which is a kind of insulting between bullying,usually associated with beatings,torture,and haven't openly,location and relatively open,it can cause huge physical and mental damage to the growth.At present,the law of minors mainly is the protection of minors and crime prevention,mostly positive protection measures,lack of disciplinary rules,which have no a special law against bullying in our country.At the same time,Anti-bullying criminal legislation is bullying the blank of legislation,for reeducation system imperfect,the development of community correction system is not mature,School against the shortcomings of the lack of system of bullying in China.This paper mainly through literature reading,data collection and case analysis method,in the perspective of criminal law to analysis,analyzing the three issues:(1)the connotation of campus bullying,mainly through multiple points of view definition about bullying behavior at abroad,and compared with related concepts of bullying behavior,determining the understanding of the connotation of the campus bullying.(2)Criminological analysis of bullying,Analysis of the characteristics of the phenomenon of bullying in Campus and The behavior motivation of the bully from the school level,family level,youth own level and social level,puts forward the corresponding countermeasures(4)The perfection of the criminal legislation of the school bullying behavior.The corresponding countermeasures and measures are put forward from three aspects:Modification of the age of criminal responsibility of minors in campus bullying;Additional crime of violence,to supplement the defects of the crime of intentional injury;Perfect the penalty structure and execution of the application of the contact law minor.(5)The perfection of the criminal Justice of the school bullying behavior.Through perfecting the connection between criminal law and administrative law,improve the implementation of the system of housing and education in our country,Perfecting the implementation of community correction in our country,Strengthen the connection between criminal law and the law of protection of minors and the prevention of juvenile delinquency,it Can have effect on China's anti campus bullying criminal legislation.With perspective analysis of the criminal law is not only beneficial to bullying behavior caused the attention of the society level,but also to bullying problems rise to national legislation level,from the social law,criminal law on the regulation,No longer let bullying phenomena in the campus.
