With the rapid development of social economy, people in the modern society is facing all sorts of more and more pressure, mental disorders related issues has become one of the most prominent problem in society. In many countries in the world, all of criminal compulsory medical treatment. At the same time, before 2012, for such a problem in our country, there is a blank in the eyes of the law. After 2012, introduced a new "criminal procedural law". Although our country in 2012 to solve this problem in the criminal procedure law has made specific provisions on the law, but at the same time, in practice has emerged a lot of problems. The provisions of the criminal compulsory medical treatment system in our country is too straightforward, so many detail problems of the specific practices are not considered, so theoretically discusses our country’s criminal compulsory medical treatment system is necessary.The First of all, we have to understand the concept, the criminal compulsory medical treatment system, has the vital significance, and also lay a solid foundation for our study. After clear its concept, positioning the nature, then its value is discussed. Secondly, the criminal compulsory medical treatment for comparison, the United States and China have compared to just have a reference, using the comparison we objectively face the shortage of the current regulation in our country, at the same time, fully absorbing the precious experience of exploring the American system, is the research of our country criminal compulsory medical treatment system to provide useful ideas. Again, discuss the system in our country existing status and its regulation, analyzing its shortage at the same time. Finally, in view of the deficiency, we discuss put forward Suggestions to improve it.
