Nigeria is the largest economy entity of the Africa, is also the most populous country of the Africa. For a long time, there is a serious unemployment problem in Nigeria, thus protecting the national labor market, reducting the unemployment phenomenon is an important affair of the successive Nigerian governments. As many other African countries,, In order to maintain national interests as the basic starting point,Nigeria carry out the strict foreign labor policy formulate an explicit restrictions on foreign employment's legal system.The 1963 immigration law of Nigeria is an important legal basis of the restrictions on foreigners' employment system, which stipulate that ” Anyone with a poor record or with prejudice to interests of Nigeria or to commercial activities shall not work in Nigeria, it laid the basic requirements for a foreigner's employment in Nigeria.The legal system to limit the employment of foreigners of Nigeria includes foreign labor quota system and work visa system. The foreign labor quota system is the most important for the restrictions, it refers to the Nigeria companies to hire foreign workers must apply to the Ministry of the Interior and obtain its approval about the exact number of foreign labor quotas. The main suitable object of the foreign labor quota system are those enterprises which need to hire foreign labor. In addition to the complicated application materials and strict approval procedures, there are strict qualification requirements for the enterprise, for example, the capital requirements is that minimum share capital of more than 10 million naira, high corporate tax certificate, the high application fees, etc, thus for controlling the number of foreign workers in the enterprises effectively. The work visa system reflects that the Nigerian government makes visa restrictions for the foreigner workers in the individual entry link, mainly by setting strict work visa conditions, approval procedures and deadlines to restrict the number of work visas issued, in order to achieve the purpose of restricting the employment of foreigners.Overall, the Nigerian legal system to limit the employment of foreigners has the following characteristics:1.Protecting the needs of the domestic labor market fully. 2. Implementing the foreign labor quota system of the prescribed limits and controlled the total amount. 3. Approvalling of the foreign labor quota to consider economic and industrial development, labor supply and demand situation and the ability of foreign workers. 4. Hiring foreign workers to meet certain restriction on trade and position restrictions. 5.Foreigners apply the work visas must take the foreign labor quota of enterprises and work invitations as a precondition. 6. Foreigners must have a legal work visa prior to apply for their residence certificates.For the strict foreigners' employment legal system in Nigeria, it's difficult for our citizens to handle the related employment application procedures of Nigeria, and the living conditions of our citizens in Nigeria employment is not optimistic, Therefore, our citizens should not go to Nigeria blindly for employment, in order to avoid their own interests is difficult to obtain reasonable protection. Chinese enterprises in Nigeria should pay attention to the localization constructing, hiring more Nigerian as domestic employees, it may be more conducive to the long-term development of enterprises.
