| The people’s court is the ultimate practitioners of judicial justice. Judicial justice is eventually reflected justice in the process of court trial and trial result, so the court needs a practical and effective internal supervision mechanism to ensure the justice of trial procedure and entity result. The well running of internal supervision mechanism not only can effectively defense judicial corruption, but also can improve judicial efficiency, strengthen the case quality and promote social equity and justice. However, currently, our country court internal supervision mechanism still remains many problems. It mainly includes unsound internal supervision mechanism system, abnormal operation, imperfect responsibility investigation standard, interferes with the independent trial and so on. These problems are not only legal scholars’discussion hotpot, but also the basic level legal workers’the first facing problem. The causes of these problems are diversity, for example, the supervision and the supervision body who are lacking of internal supervision mechanism importance awareness, administerization intervention, the raising quantity of cases, lacking of human and financial guarantee etc. Only by the method of applying the knowledge of public management, scientific analysis and the earnest investigation and study, the court internal supervision mechanism can be well recognized, established and performed. And thus achieve the good effect of defending judicial corruption, improving judicial efficiency, strengthening the case quality, and promoting social equity and justice.The writer firstly through our country, Soviet Union, Mainland, British and American etc. major law systems of National courts’internal oversight mode comparatively study, by the using of working conditions, combined with the author work unit Liaoning Y Municipal Court, from two aspects of the judicial function and administrative function analysis the Liao Ning Y City Court’s internal oversight mechanisms facing the practical problems and thus find the causes of the problem raised. Secondly, through the inspiration of domestic and abroad courts internal oversight mechanism, the author explore ways to further improve internal oversight mechanisms of Liao Ning Y municipal court and carry out further feasibility studies. Finally, through scientific summary analysis, the author raise up effective internal oversight mechanisms improvement measures, such as improving internal court supervision system, developing the Court’s internal oversight assessment check standards, strengthen the court’s team subjective understanding, and reform department functions, clear responsibilities between the upper and lower levels and among divisions, return rights to the collegiate bench and weakening the administrative officials’intervention in specific cases, improving the judge misjudged cases’ lifelong accountability mechanisms, promoting judicial inspection system etc. Forming a quantifiable, full processes, normalized, "Punishment in now," and "Prevention from future", a sound internal supervision system. |
