First of all,this paper presents the change of industrial development and occupational disease identification in the world.It shows the change of occupational disease caused by different working environment and way,so as to elaborate the worldly change of labor environment and the development of industrial society backgrounds under different historical industrial background.Secondly,it introduces the legislative development and current situation of foreign and International Labor Organization(ILO)on occupational disease.In foreign countries,the legislate development of occupational disease’s identification can divided into 4 stages:Before the 18th century,the blank legislate stage of the legislate development of occupational disease’s identification;The beginning of the 18th century-The end of the 19th century,the embryonic stage of the legislate development of occupational disease’s identification;The beginning of the 20th century-The end of the 20th century,the developing stage of the legislate development of occupational disease’s identification;The last decade of the twentieth century-Now,the improved stage of the legislate development of occupational disease’s identification.Before the 18th century,there is no exists law in occupational filed,although occupational disease has already generated in daily life.With the wide spreading of 1st industrial revolution,there exists many countries began to appear occupational disease law in the specific areas and specific diseases.For the surging forward of 2nd industrial revolution,many countries have broaden the scope of occupational disease’s identification at the middle of 19th century.At the end of 19th century,the scope of occupational disease’s identification has already covers almost all manual and non-handicraft factories and establishes a part of the supporting identification system.At the beginning of the 20th century,many countries began to set occupational safety and health law and emerge the occupational diseases directory to specify the scope of the identification and form a complete set of identified method,at this period,the world basically form the wide-open occupational diseases identification system such as American,and semi-open occupational diseases identification system,such as German and British.As similar to many foreign countries,at ILO,the development of occupational disease legislation is also spending a period of gradual opening stage,in this stage,both the occupational disease scope and the corresponding system have already changed.Thirdly,the development of Chinese occupational disease identification is also the process of gradually opening,refer to the relationship between the existing identification system and the current development of market economy.Current Chinese occupational disease’s identification system still exists many problems,such as the disconnection between the relevant laws and regulations and the occupational diseases are not open enough.Finally,referring to the evolution of the occupational disease identification in different countries and times,the paper puts forward the suggestions on the improvement of occupational disease identification in the new era including perfecting the relevant legislation,clarifying the relationship between the different legislation of occupational disease identification,expanding the scope of existing occupational diseases identification,add the broad category,new occupational diseases into the directory such as "overwork death,latent occupational diseases," shortening the adjustment time of occupational diseases directory and setting a clear adjustment cycle,establishing a dynamic adjustment mechanism,and establishing the complement of broad category occupational disease,establishing the health record system for employees,setting the national experts data,entitle the local government to reported and feedback,so as to adapt to the currents development of contemporary economic society and better response to the needs of society.
