Research On The Key Terms Of Agent-Construction Contract Of Village Renovationproject Invested By Government

With the rapid development of China's urbanization and the deepening of the investment system reform,the implementations of the agent construction mode in the renovation projects invested by government have been increasing rapidly.This construction mode facilitates to improve the manage level of government-invested projects and remarkable achievements of investment benefit have been made.Compared with other construction contract,the agent-construction contract involves in tripartite,which are agent,project investor and project user.Because there are no model contract can be referred to,the practice of village renovation project by agent-construction form was in the lack of guidance.In this article,firstly the concept of agent-construction system was explained and the current practice modes of agent-construction were studied.The subjects of agent-construction contracts and the legal status of the agent-construction contracts were analyzed.Through the comparison with other similar contracts,it can be found that the agent-construction contract shares the same properties of the commission contract,which indicates that the two contracts belong to the same category.Secondly,the concept of the government-invested village renovation project and its present developing situation in Qingdao city were introduced.Furthermore,the characteristics of village renovation project are demonstrated.In order to achieve more understanding of the agentconstruction contract,studies of the key terms of this kind of contract related to the village renovation project are conducted.The evaluates in terms of the scope and content of the construction work,the rights and obligations of the agent of the construction contract,the agent construction fee and the responsibility contract breach,are given in details.Finally,based on the studies of the key terms mentioned above,a typical application of agentconstruction contract was exhibited.The impacts from the key terms to the contract parties were studied the implementation process of the entire project was demonstrated.Based on the agentconstruction contract terms,each party fulfiled their duties in close cooperation.And therefore,the contract objectives were ultimately achieved regarding the project investment,progress,quality and safety.Correspondingly,the villagers benefit from the smooth return and agent company win a good reputation from both their clients and the users as well.It can be concluded that a good understanding of the characteristics and key terms of the agent-construction contract plays an important role to ensure the success of village renovation project.
