Abstract/Summary:
Ship collision accident has always been the first among all kinds of marine accident,proportion of liability for each party concerned in ship collision is a difficulty in this field.In order that the liability to be proportioned quickly,fairly and accurately,on the basis of the summarization of "1972 International Regulations for Preventing Collisions at sea"(COLREGs)and analysis of the provisions of relevant laws and regulations,combing with case analysis,this paper build up a detailed evaluation system for collision avoidance action for different collision stages and finally established a model of auxiliary decision system for ship collision liability proportion which may provide recommendations for liability proportion in judicial practice.The main research work in this paper focus on the following aspects:1.A brief analysis on the COLREGs and relevant legal provisions on collision avoidance alert and action rules,as well as a summary of requirements in different encounter situations and environments.2.Based on the current achievement of the research and combined with provisions of COLREGs and cases investigation,selected the collision avoidance alert(look-out、safe speed、sailing alert、judgment for the risk of collision、special provisions)and collision avoidance action as evaluation index,build up a evaluation system for collision avoidance action for different collision stages and finally established a model of auxiliary decision system for ship collision liability proportion.3.Based on the yaahp software,the questionnaire was designed and the weight of the evaluation index of ship collision avoidance fault was determined based on analytic hierarchy process(AHP),combined with the fuzzy comprehensive evaluation method and the weight determined,a model of auxiliary decision system for ship collision liability proportion is established by MATLAB software.4.The model established in this paper was verified by the existing accident cases in different encounter situations and environments.According to the experimental verification of the case,it is reasonable and feasible to apply the AHP and fuzzy comprehensive evaluation to the model of auxiliary decision system for ship collision liability proportion and based on the collision stages to construct the evaluation index system,this model can provide effective auxiliary decision for ship collision liability proportion.
